1. Overview
TowHub is an online marketplace that connects trailer owners (“Hosts”) with individuals seeking to rent trailers (“Renters”).
TowHub is not a party to rental agreements and does not own, supply, or control any trailers listed on the platform.
2. Role of TowHub
TowHub acts solely as an intermediary platform.
- Rental agreements are between Host and Renter only
- TowHub does not guarantee:
- trailer condition
- availability
- safety or legality of use
3. Eligibility
Users must:
- Be at least 18 years old
- Provide accurate information
- Comply with all applicable NZ laws
4. Account Registration
Users must:
- Maintain accurate account details
- Keep login credentials secure
- Be responsible for all activity under their account
5. Listings
Hosts are responsible for:
- Accuracy of listing information
- Availability
- Pricing
- Legal compliance of trailer
TowHub may remove or suspend listings at its discretion.
6. Booking Process
6.1 Request-Based System
- Renters submit booking requests
- Hosts accept or decline
6.2 Payment Trigger
- Payment is only required after host acceptance
7. Payments
7.1 Payment Processing
All payments are processed via Stripe.
TowHub:
- does not store or hold funds
- does not operate escrow accounts
7.2 Fees
TowHub charges:
- a service fee to Renters
- a commission fee to Hosts
These fees are:
- disclosed at checkout
- non-refundable except where required by law
7.3 Payment Authorisation
By completing a booking:
- the Renter authorises payment via Stripe
- funds are transferred according to Stripe’s processing terms
8. Cancellations & Refunds
- Cancellation terms are set by Hosts
- TowHub may assist but is not responsible for refund decisions
9. Damage & Liability
TowHub is not responsible for:
- damage to trailers
- personal injury
- loss of property
Responsibility lies with:
- Host and Renter under their rental agreement
10. Disputes
- Disputes must be resolved between Host and Renter
- TowHub may assist but has no obligation to intervene
11. Prohibited Conduct
Users must not:
- bypass TowHub to avoid fees
- provide false information
- misuse trailers
- engage in unlawful activity
12. Suspension & Termination
TowHub may suspend or terminate accounts for:
- breach of terms
- non-payment of fees
- misuse of platform
13. Limitation of Liability
To the maximum extent permitted by NZ law:
TowHub is not liable for:
- indirect or consequential loss
- loss of income
- damage arising from rentals
14. Governing Law
These Terms are governed by the laws of New Zealand.
